As i understand it it may take upto 6 mons and may even take upto a year. Is that a safe bet? to I am planning on a vacation in Dec and i hate to be in limbo. My wife's I-140 has been approved and we are in the worldwide category.
So what do you guys think, should i just go ahead and book the tickets now or should i wait to see what happens in Oct? I would like your opinions however contrary :D

Hello gurus,
My H1 expires in march 2009, I have valid EAD and AP, I want to renew my H1to be on the safer side.
My wife made use of her EAD for few months and now she is not working, and we are planning to visit India for few weeks next year and get H1 and H4 stamped.
here are my questions:
1. Can my wife get her H4 extension when I apply for my H1 extension ?
2. Does USCIS know that she used her EAD (Is there a way that they can find out) and will there be any problem in approving H4 extension ?
3. Now that she is not using her EAD, Is she back on H4 status ? She came here as H4 and never made a trip back.

Hi,
Is it possible for a resident of Pune to apply for a tourist visa at the Hyderabad consulate? The Mumbai consulate doesn't seem to have any openings online, so not sure how to make an appt with the Mumbai consulate..

My company is offering my retention contract for 3 years. As I told them that my GC can take long and I haven't filed for I-485 to use AC-21, I will be in trouble if a loose my job. Based on that they are making a written promose that I will have a same job for the next 3 years with all benifits and the only reason I can loose my job is through a decipline action (bad performance, fight, harrasment, etc).
I want to ask the attorney's and gurus if there is such a contract exist and does it have any value ?

Folks,
I just realized that I forgot to add a piece of my employment history to the DS-160. I only realized it once I set up the appointment for H1-B stamping through VFS. I have all the corroborating paperwork (W2, paystub etc.) for that period. Do I need to re-do the DS-160? I already have an appointment and if I cancel the appointment and re-do the DS160 I might run the risk of not getting the date of my choosing. The problem is my existing company is a "successor in interest" of the company I forgot to mention. That is, I got my I-797 from this previous company.
Please not that the facts in the existing DS 160 are true. It is just that I realized that there is a gap that I might have to fill.

I have a EB3 case from employer A, and an EB2 case as a future GC from employer B , and got the date ported from EB3 case to EB2 , got EAD and AP .Now I have started working for employer B on EAD, for the past 3 months, and now my contract might expire with the client and loose job, I have found an other job , but have to leave employer B, now my question is, can I file AC21 and leave my GC sponsoring company(employer B), or is it a very short time , and raise any doubts on being a "NO GOOD FAITH"case.Please help.All I 140's are approved.

My wife was deported after being in the US for more than 9 years. She spent 4 months in jail. Your first question will be why didn't I get her papers for her, she didn't want to go through the hassles. We have been married for 4 years. She was arrested when we attempted to return from Mexico after a vacation she was on. They confiscated the vehicle and I was released without a record, gave me a break because I am retired military.
I have heard that there is a pardon process. Since the rest of her family is still in the US, we want to be able to return. I am in the process of moving to Mexico to be with my wife.
Can anyone shed some light on a "Pardon"?
