    I am currently working on H1B. My wife is currently in India with approved I797 for H1B (starting Oct 07). We are debating whether to get H1 or H4 stamped on passport. (H4 is totally our decision and for H1 we need to depend on her company's schedule).

    - Can she come to the US on H4 (lets say next month) and if and when she finds a job (lets say next year), can she switch to H1? Is there a time limit before H1 will become invalid?
    - If she comes to the US on H4, are there any issues changing status to H1?
    - Are there issues when she goes to India again to get H1 stamped?
    - Is there a difference between the I797 approval notice if a person is out of US vs. in US? (I have read something about I-94. I thought I-94 is always attached to 797 approval notice).

    Thanks, I will appreciate any useful info.

    Nikon is taking their time with this one, as they're taking their time with the WT-3 transmitter for the D200. I am interested, but by now I've invested a bit too heavily in a DNG-based workflow by converting everything to DNG and attaching IPTC metadata, to consider Capture NX as a serious contender for my workflow. Though, I do imagine that I'd use it for those rare times when I need a really high quality conversion for very large printing.

    I am in 6th year of my H1B. It is expiring in Aug 2011.

    Here are some details:
    - My I-140 is approved with a priority date of Aug 2006 under EB2-India.
    - I did not apply for I-485 so I do not have a EAD.
    - My wife is also on H1B which expires in Aug 2012.

    Here are my questions:
    1) If I apply for H1B extension in July 2011 under regular processing and assuming it takes 4-5 months for USCIS to process the application, can I still continue to work? For how many days can I work if visa renewal is still in processing after the visa has expired.
    2) If I get a denial of H1B extension do I become out of status from the date of denial or from the day H1B got expired?
    3) If I get a denial of H1B extension can I immediately apply for H4 as a dependent to my wife's visa without any issues?
    4) If I get a denial of H1B extension, what happens to my I-140? Is it automatically invalid?
    5) If I do convert to H4 status and my priority date becomes current can I apply for I-485?

    my company have applied for H1-B & H4 extension for myself and my wife. My wife now is looking to go for work and has got an offer from a company. The company will be doing a premium processing of my wife's H1-B and it is expected to be approved in 2 weeks. my wife has already held H1 status before, so she doesn't fall undr the cap. If my wife's H4 comes thru later, what status will she hold?

    Hi,

    I am a July 2007 filer (EB3 India). In the coming weeks, my employer is opening up senior position in different states and has encouraged existing employees to apply.

    If my employer is open to offering me a job for the new position, (and process a EB2 PERM/I-140 for the new position) what would be my option with the existing I-485.

    Is it recommended to keep the existing I-485 as is an file a new one? Or should the existing one be updated with the new I-140 (EB2) when that gets approved? How does it affect AC21 portability if existing I-485 is updated.

    I received my EAD today, but my I-140/I-485 are pending. Is the EAD of any use right now? I think I have to wait for the I-140 to be approved before changing jobs, right?

    It's true that Obama is focusing on the economy now, but if we do a massive flower campaign now it will get us press and attention and "loosen" things up, then we can go for a second even bigger flower campaign in the spring and in the summer when the previous flower campaign will still be alive in the public's memory. That way people will say "wait, legals? that's different than illegals, and it sounds serious"

    We need to get ourselves noticed! The illegals had Obama on the Hispanic radio show with "Piolin Sotelo" last week. Why aren't we doing anything? We are not cowards, are we? The illegals can but we legals can't?

    Let's not stop with the flowers until we're heard. We send this week, then in a couple of months and so forth until they fix the injustice we're in

    I'll send the first bouquet of flowers to USCIS or DOL or the WHite House if I can get 10 volunteers to send with me. Who's with me? Let's send them this week. Who's in?

    I recently got an RFE for my I 485 Application.

    Need to prove my non-immigration status from Nov 29 2007 to Nov 24 2008 .

    I have I-797 ( H1-B approval ) for the above mentioned period. But My Last Name in the approval has a typo error ( in place of letter A they misstyped U). My Enployer has opened a Service request to correct the Name in H1 B approval. But he is saying that he never got the corrected approval. Time went by and i applied for H1 ext..i got the H1 extension from Nov 25 2008 to Nov 2011.

    So My question is

    Is it okay to submit all the documention that was sent to USCIS to correct the name along with the I 797,I-94 for the above mentioned period and explain them that we did not recieved the corrected I-797 ? or not

    Please suggest me ..

    I posted this message earlier in some other thread. Actually my questions were irrelevant to the thread I added the message on. Hence, creating a new thread.

    I have couple of questions regarding GC filing for future employment.

    a. Is it legal to work for company B if one is working for company A and company A has already filed LC?

    b. Any danger of getting audit because of multiple LCs?

    When exporing new oppty's via AC21 with companies:

    is it Ok to share copy of one's 140 or 485 document copies?

    approval notice copies should be ok (check with company's HR if in doubt). However supporting financial/planning documents of a company may not be ok (that kind of stuff could be confidential to the company)

    Hi all,
    Has everyone filed on or after August 10 th and has recvd a notice of action (I797)?
    Also, do you know if we have to do the Fingerprints before we get the EAD or do USCIS sent EAD and then request fingerprints ? Thanks!!
