Hello,

I have just got my green card and I am filling out I-130 form for my older son who was 21 when I submitted my I-140.

My question goes to point 16, "Has your relative ever been under immigration proceedings?" as I am not sure what to check over not knowing the terms (Removal, Exclusion/Deportation, Rescission and Judicial Proceedings).

I am asking that as my son has been denied admission in the US last summer. He had an F-1 visa (through 2014) but changed schools, got another I-20, went to the US Embassy in my country, the Embassy denied him a new F-1 visa but they didn't stamp with "Cancelled" the F-1 visa in his passport so he thought the visa is still valid, returned to the US but in airport he was not admitted entrance and had to fly back to our country.
Sorry for my long explanation I just want to find out if what happened to him falls under one of the 4 Immigration proceedings under article 16 in I-130 form.
I want to get him here not have him banned for ever for not knowing correctly the terms.

Hi Gurus,

I am in my 9th year H1-B. I have my I-140 approved and I-485 pending since July 2007 through employer A (EB-3).

Employer B is willing to hire me on H1-B (transfer) using AC21 portability (and similarity of jobs). After the move, employer A will revoke my I-140 for sure.

Can I apply for an H1-B transfer with employer C after a year or two using AC21 portability? I do not want to use EAD. I want to use H1-B tansfer (3 year extensions)?

This is a major decision that I have to make.

Please reply at your earliest convenience.

Hi Everybody!!

I am new at this site and I have a question!!

My lawyer submitted the ETA 9089 on Dec. 2007 , we've been checking the case # A-XXXXX-XXXXX and the only thing that shows is: PROCESSING...

Isnt supposed to be 30 days??

My situation is really bad because right now my driver license expired and I cant renew without an Immigration Case Number, but my process stil on DOL as "processing"

Any suggestion or Comments??

Restamping is not required. But just make sure you show your new approval notice to IO at POE. Done this couple of years back

Trying to help Mother-In-Law over from China for visit. Unsuccessful w/ tourist Visa process, so now going for Green Card. Received Notice of Decision against me, unable to establish my Petitioner wife is daughter of Beneficiary Mother-In-Law. No hospital records. Previous evidence was "Notarial Certificate of Relationship." I have just received new evidence "Notarial Certificate of Birth" from civil authorities - along with affidavit from school teacher - I need to file EOIR-29, I think to call it APPEAL, OR IN THE ALTERNATIVE, MOTION TO RECONSIDER - can anyone provide a "go-by" as to what format my letter should take? Is letter format acceptable or is formal pleading format needed?

Time is of the essence, I have to file within 24 hours or give up and pursue DNA testing....

My wife's I-539 got approved this month (H4 -> F1). My lawyer said that applying for AOS is not an issue as long as she does not travel outside the country while her AP is pending.

How about this ? Lets say your consulting firm is ready to file your I-485 upon lots of restriction such as two year agreement and to spend around 10 gran.

While the big firm who has filed the PERM and waiting for the approval. In this case, can we do both the cases to see which is better upon the current situation.

This will help few of our folks and your thoughts are always appreciated.

I have my H1B visa with NIIT. My petition and visa for the first 3 yr period expire in October 2008. I am returning to India in April '08 to do my MBA, and will resign from NIIT, and therefore will not be able to renew my visa.

If I want to work in the US after I graduate, say in August '09, can an employer file a transfer petition based on this visa? Or Will they have to file for a new one under the quota? And if so, is there a way that I can hang on to my H1 status?

Hi,

I am planning to travel to Indian in coming months. However, I have a stright outright dismissed CMIT case back in 2007. I got the non convincted case expunged. I got FBI finger print results and they say no records were found. I got BCI from state which states no records were found. Last time , I travelled abroad was in 2006. I have a valid AP.

Do you see any risk of re entrying US on AP?.

Your help is much appreciated as I have to have to be there in India.

There has been an error in the processing of my I-130 petition for my mother. It was approved and now I am being asked to submit form I-485 or form I-824. The problem is that my mother is not and has never been to the US. I called CIS and talked to a representative about the error. She said she would send a letter to the CIS about it and that I should hear back from CIS in 5 days. I am just wondering if this timeline is realistic or I should expect it to take more time. Should I contact my senator and ask for assistance in facilitating this process? Would hiring a lawyer expedite this process? I know that the petition should then go to the NVC. Would a lawyer help?

I applied for I485 like many others in July. I just heard my group may be spun off from its parent company and might be funded by VCs. Does this mean I cannot use my LC/I140? If/When I get my EAD will it be valid?

No big deal....It does not affect you as long as your job is still same. The new company will take over your labour and I140 and you should be fine
