Last year, employers submitted so many H-1B petitions, the USCIS had to pick the winners by lottery. This year, seven months after the opening of the filing season that started on April 1st, the H-1B cap has yet to be reached. However, the numbers may not last long. During the first week of April, the USCIS received almost enough H-1B petitions to fill the 20,000 cap for persons with advanced degrees, but only 43,000 petitions against the 65,000 general cap. Hi- I'm e-filing my I-131 and it is asking where my I-485 is pending? How do I find this information? The cases status online does not give away this information.

Look at first 3 letters of your i-1485 petition. If it is:
EAC - Vermont Service Center

Currently on H1B 8th year extension which will expire on 25th June, 2009.
Labor PD: 9th August, 2004
Labor cleared: 11th September, 2007.
I-140 (approval pending) filed on 4th October, 2007. Received at USCIS on 5th October, 2007.
Can�t file for I-485 since the EB3 date for India is unavailable.
There is a high chance that I might be laid off at my current employer in the next 2-3 weeks.
Can I transfer my H-1 upto June 25th, 2009 (or later) as well as start a new PERM case in EB2 category?
In case of the above H-1 transfer, will the new H-1 be valid for 1 year from the filing or will it be upto 25th June, 2009?
What are my other options not to go out of status or leave the country?

As expected this happened, but it happened sooner than expected.
This expected sooner because CIR was voted out in Senate and this was not thought about by this goverment.
Basically this was a close door arrangement between govt agencies which temporarily wanted to lower the friction by IV AND SIMILAR GROUPS.
BUT finally I believe this will come to a rest once we have new government next year.
Till that we are a tennis ball which can be tossed to any court.
PS: I dont even have I-140 and not even applied for one.

USCIS kept on updating the total number of cases received for H-1B for FY 2009-10. However, the recent USCIS H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap count indicates decline in number of cases than what had been previously reported. The updated count reports the receipt of 44,400 �Regular� cap cases, by June 12, 2009 which is lesser than the prior count of 47,700, given as of May 22, 2009. There is no explanation too from USCIS for this decline in trend. Thus, this reduced number may reflect either withdrawals by employers, denials by the USCIS, duplicate filings, or an error in the prior cap counts.
As of this writing, both the Advanced Degree and Regular caps remain open. We will continue to provide updated H-1B cap count information.

Hi all,
I had my h1 issued in nov '09 and was laid off from the company in march '10. However, I was able to secure other position in the same company a month later. But now the company wants me to exit/re-enter the country (and get my visa stamped) before starting the new position.
Since I was technically out of status for the month of April (and don't have any paystubs for the same), will it be difficult to get my h1 visa stamped? Also, can I get my stamping done in Canada, or will I have to my home country?
