Nebraska has issued only 2800 receipts for today...
How do you guys get this daily update.. going by this, it will take them 2 months just to clear first 2 days of july - even after assuming all receipts issued are for I-485 cases, which is far from truth!

Thanks all for the updates. Also the loan agent I am working seems to understand, the underwriter is the one causing issue. I-140 approval has already been submitted along with EAD copy and I-485 receipt, Still they need the visa copy, which is expired in my case.
Will try talking to them again. I have sent an email to Bank of America customer service wiith details and hope fully they respond back.

What if you spend 3-4 K in the new GC process, and after writing these letters USCIS wakes up and release statistics that they have 2000 EB-3 I pending for 2002/2003 and 1000 for 2004 will you still go ahead ? I guess for us the most important thing is to know how many cases are really pending. As I am not filing a new EB-2 and what if there are 15K cases in 2002/2003 and 50K in 2004, I'll be sitting here all my life looking at Visa bulletins :o
GC Life screwed me badly, couldn't file in EB2 2 times even though eligible because of a couple of idiots, only action item I can think for myself is re file in EB-2 which I am doing it very soon and have an appointment wirh Mr.Khanna tomorrow.

I know things might change , i wish this law doesnt pass through at all. But in its form this is interpretation of major members and attorneys in current stage. Please correct me if i am wrong.
I might agree with your conclusion of start date, but Now coming to to cases :
Petetion for an employment based visa = I 140 , that were filed prior to the date of intro ( for our sake its Oct 2008 or May 15 2007 ) that were pending or approved , shall be treated as if such provision remained effective.
An approved petition may server as basis for issuance of an immigrant visa.
and for all people who are still in Labor stage will preserve their priority date.
Now based on this , if you have filed an I140 before the date of enactment what ever it might one should be fine. Once dates becomes current and I140 approved one can file for 485 in previous system.
I dont see any conclusion based on 485 is approved or not its just adjustment of status once PD become current , i think its all 140 that determines you are approved as an immigrant or not.

Dear IV,
Its not about me. I am planning to do a flower or some campaign that all will agree upon in less than a week. We must do before the next bulletin comes out.
Is it possible for IV to send a very good number of flowers to the departments.
i believe IV leadership has mentioned many times that 'more visa numbers' is the only solution to this mess. Which can be only done by changes in law.When IV planned some thing for it (recapture bill phone call campaign) the participation was not great.
I wonder, every one running like headless chicken solves any thing.

Hi my son is going to turn 21 on June 6th, we had applied for EB3 labor certificate on in July and the priority date is july 19, 2005. The I-140 was applied and approved in a month, therefore he will turn 21 next month on the 6th because the subtraction of one month from his age due to delay by USCIS in processing the I-140. My question is that is there any sort of help for EB retrogression for the children affected, and may get aged-out. As well as any other way that my son can apply for his I-485.

Between June 1 and the first few days of July (?), the USCIS requested and was authorized over 60,000 EB visa numbers, in approximately one month. Since it has been made clear by the USCIS that during the last weekend of June 30 and July 1 (2 days) the USCIS approved 25,000 EB 485 applications, apparently over 40,000 visa numbers were requested and authorized before the weekend in a period of less than one month. Obviously the 60,000 plus cases must thus have been approved (?) in one month. Unconformed sources indicate that they processed and approved (?) a substantial number of applications on Sunday, July 1, exhausting the EB numbers by July 1 and making the EB number unavailable not from July 1 but from July 2, 2007. It is interesting that even before the legal team initiates any discovery, the truth starts coming out of the cabinet a bit by bit.

There are plans on IVs agenda to see if we can collectively help ourselves on these issues.
I recommend all members to use every channel you get to fix issues like these.
We are entitled for a fair process and we must make sure every application is treated in a fair manner.
Folks - anyone can face these issues.

28.6% of 7% of 140,000 per quarter is 700 not 2450.

The 7% per country limit applies in the first two quarters independent of EB category. Hence the 2450.
Unless, of course you are again dividing that as 28.6% per category - suspect EB1 takes up 28.6% of the 2450...
Anyways, like several have pointed out, USCIS is beyond all this logic! :)
