Hi,
Find below my current visa status
1. H1B 6 years completing in Jul 2009. My firm will apply for extension in March time frame
2. I have applied for I-485 and have EAD + AP.
I am planning to travel to India for a week on AP sometime in May. I have the following Qs on this
1. Can I travel to India with AP when H1B extn is pending.
2. Will I face any issue while entering the US if my H1B is denied (or) there is an RFE on my appln?
Please answer these for me.

My Wife Has entered US with H4 on April 16th 2006
Her H1 Visa Approved for her on : Oct 1st 2007
Worked on H1 with an Employer: May 2008 to Oct 2008
Later: From Oct 2008 to Now -- NO PAYSTUBS
Her employer advises her to cancel her H1 and change back to H4. Will there be any problem with this? And how do we go about it.
Also to add to the problem, I have actually filed my H1Visa extension which expires on May 09 and got an RFE on the same. My Employer is responding to the same. Based on this case, How do I go about applying for my wifes change of status
Would appreciate your help on this

I have a Vaid H1 Visa which was issued by my previous employer on 2006.But I did not use the VISA as I entered US as a student and have never worked in the US on H1.
the new employer is willing to sponser my h1. As I was already counted in the cap once within past 6 years, I need not wait till april to process my application.
is this correct?
If one is in some other status other than H1 currently, They don't need old paystubs for the transfer.I need a copy of the I797 or the receipt number of my old H1 for transfer.
I can provide the receipt number which is available on my visa. My previous employer is not willing to give me a copy of I797.

Since your child turned 21 even before you submitted your I-140, the answer is NO, you cannot submit I-485 for him as he is not covered by Child Status Protection Act, CSPA.

Now that USCIS has dropped bomb by announcing the revised bulletin, do you think now they will be able to bring back the premium processing for I-140? or still they dont have time to "ensure" processing in 15 days.

The extremely contrasty background doesn't help, and the blown highlights on the dog's nose are also distracting. I'm not sure how much it would help, but you might try using fill flash (that still won't solve the background issue). Shooting on a day that's not overcast might help bring the sky into range.

Hi,
My employers are considering transfering me to another group company (different name) during the next 1-2 months. My job profile will remain unchanged, but the employer name/address (on paychecks, etc) will be different after the transfer. My I-140 is still pending (filed in Aug 2007 together with I-485 at NSC under EB-3).
I'd greatly appreciate anyone's advice on the following:
a) If I transfer before my I-140 is approved, do I need to notify USCIS in writing? If so, does any specific paperwork need to be filled out? My employers have assured me they will continue to support my I-140/485 under the original company name, for as long as required.
b) If I transfer after approval of I-140 (fingers crossed!), do I need to notify USCIS? Again, is any specific paperwork necessary?

Please provide a ready reckoner on AC21. Like the basics. This would help lot of people trying to switch employers including me. I know there were memos written by Yates and other lawyers. Your real experience on this matter always counts and helps people.

My wife had misplaced her AP summer of last year when she was out of the country. She then entered back on Transportation letter however at poe the immigration officer assumed she was a resident misplaced her resident card and stamped her passport as LPR. Since her entry back in the summer of last year we have gained an extension of H4 status for 3 years. I am getting ready to file for a new AP and would like to know if I should writeH4 as her "Class of Submission" or LPR or AP

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

yes. you cannot file AoS while out of country. you can file for yourself, but will have to file for the dependent/s when they return.

I know people with such extension. They didn't have any problem for visa or travel.
