    My H1B was approved for location A (MICHIGAN),ONE MONTH AGO.Now my employer wants me to work in location B(PA).My question-
    Do I have to wait until labor is approved for location B or can I start working from monday and labor(for location B) can come in 10-15 days thereafter.I am a PT.

    I have an Indian passport and currently working in USA on L1B visa. Before leaving India I initiated the process of getting permanent residence visa from Australia and while I was in USA I got the AU Independent (Migrant) Visa (Subclass 175) visa approved and it was stamped on my passport by the AU embassy in Washington DC.

    My queries are:
    - I am planning to go for a vacation to India very soon. While returning to USA will it be a problem with my Indian passport having both USA L1B visa and AU migrant visa.
    - For the initial entry to AU, I want to go there next year only for a week directly from USA. Will it be a issue for me to enter the US in my return trip

    Your advice on this will be very helpful.

    I am in an interesting situation, my 485 is pending (PD June 22, 2006) and wondering if I should accept a position offered by my original GC employer, special when my PD is so close ( May take another 6-8 month).

    I was part of company lets say X, a join venture between A&B. X applied for my GC 140 and 485 when I was with them. Then that company was split and 10% employee went to A and other 90% to B. I was part of 10% that went to A and did AC21 to port my case. It was considered as new company. Now my Old manager who moved to company B is offering a Job with significant promotion. Since X was technical acquired by B and X was my original employer, is it a win win situation to move or I stay put and wait for PD to become current before moving? job profile is goign to be same.

    Can I work with different employer without my sponsor company knowing about it? I have a EAD and I can change jobs(180 days is over). Now planning to start a company/to work on W2 with new company. I want to use the medical benefits from sponsor company(withought quitting the job).
    currently I am on Bench. so parent company not paying anything. I appreciate your responses.
    Please let me know any good immigration lawyer in Newjersey (princeton) area.

    Good morning and thank you for reading my message and considering my question

    My attorney has filed an appeal with DOL regarding my prevailing wage, which my state workforce commission rejected (deeming it too low). We were told that we should expect a response from DOL in about 3 weeks, but it has now been close to 10 weeks and we have received no response yet. The attorney is checking with DOL weekly but there has been no response thus far. Is this normal? How long can I expect to wait for a response? Thank you very much in advance for any guidance!

    Hi

    I have applied for I-140 thro Substitute in March 2006(15 months ago) and I got a query on my education and company financial status in August 06 and attorney replied back to query in the month of October 2006.
    When I check my status online shows as "we received your application on October 20th 2006 and in process".

    Last month there was an updated date on 05/25/07 on my case and when i checked with employer, he says we have not yet received any information from USCIS to attorney.

    Now the attorney says, we will be Re-filing my case, as one case got denial from my company (Not mine itseems). So that we will get new Receipt Number as I have only 8 Months left on my H1 and we can apply for 1 year extension meanwhile before 6 months of H1 expiry.

    Is it a good idea to re-file I-140 from the same Service Center(NSC)?

    or Can I apply in PERM now as I have only 8 months on my H1.

    Pl. suggest.

    I had started my anual subscribtion this Friday (4/10/09). How long does it take to be admitted into the donors forum? I have sent the email with details that same day itself. I have not yet recieved a reciept or any RFEs. Hope there is no backlog:D:D:D

    I read in one of the threads (couldn't locate it now) where USCIS asked for the financials from the new employer in an AC21 case. So just be prepared.

    My company has just started my GC process and the Prevailing Wage is the first step before they can post my job.....

    Our lawyers told us about 2 months....is that correct????

    I am kind of confused about my situation. Will try to detail it; any help is greatly appreciated!

    I was working with company A until July 2009. They had filed my F1 to H1 COS Application in April 2009, which got approved. I have the receipt for that. I lost my job in July 2009 and found another one. My new employer, Company B, filed a NEW COS Application (which they said is subject to the H-1B cap, which is confusing cuz they could have used the receipt number from my previous approval I think)

    Anyway, I contacted the attorney from Company B and they said I should call company A and have them cancel my H-1 COS Application. I called the attorney from Company A and she said she would cancel the H-1 Application. She also mentioned about ME having to send a letter to USCIS. Why do I have to send this letter? Is it so that I can go back to my F1 status? What should it say?? Please help!

    Hello Friends

    My husband was an employee of a desi company and they had withheld part of his salary, he filed a complaint at the DOL and got the pending money back.. that was 4 years back.. now he is trying to change his job and the new employer wants to do his background check..

    what will show up in his background check? will the case against his employer affect him? we are really worried about this.

    Since you're already using EAD, you are no less safer to take up a new job. The most important thing is to be able to keep renewing your EAD til your GC arrives.

    Here is my situation, my PD is March 05 and my 140 is pending for the past 3 months. Do you guys think if I get my 140 approved by Premium processing it would increase my chances of 485 approval this fiscal year? BTW, as its obvious from my PD I will be filing my 485 in July, God willing.

    The AP document should say that you can be paroled until ABC date. That is the expiration of the AP.
