I am EB3 - Dec 2004 filer and there is no hope for few years that my date get current. i have filed another GC through my sister in May 2006 and that F4 category is moving quicker and expecting my priority date will be current in 5 years through my sister.
i have bought 2 Family house in Jersey City. now for my kids education we thought to move to India for 4 to 5 years until we get call for GC though my sister.
we are going to rent house - it's multi family near NYC. my landloard is willing to take care of it in our absence.
my Q is can i get B1 (Visitor visa) for 10 years , if we show that we have property in US and we may need to visit just to take check it ??
should we inform immigration officer about GC filed though my sister to assure that we will not stay in US longer, to get B1 visa?
can we get visitor visa before leaving USA? i mean convert from H1 to B1 for multi year?

I-140 is not specific to country - the date for each processing center applies to all countries

Right now I am on my 5th year of H1B with company A. If I file for labor with Company B and got approved in a year with out holding a H1 in Company B . can i get 7th year h1 extension with company B as they already have my labor approved? any inputs will be a great help. thanks in advance.

I applied for my EAD and AP extension on AUG 17 2009 and my EAD was expiring on AUG 29th 2009. While my wifes EAD and AP got approved, I had an RFE as I had not sent the recent photographs so I sent that and the receipt date for that was OCT 9 2009.
I continued working and got paid, after speaking to friends I realized, getting paid on a Expired EAD is not right.
I have taken a infopass to discuss this with USCIS to get an update.
One more point I wanted to make was that my payroll company doesn't know about this and doesn't care. But if I bring it up then .they might immediately terminate my employment.
How do I fix this? Please suggest.

Hi,
I am planning to get my H1B extension Visa stamped in Montreal, Canada. i am in US right now. I have completed the online application. I have paid the fee through my credit card and the status of the transaction is showing as "Pending" in my bank account. I can able to see "MRV Fee Receipt Number". i can also able to see Schedule Appointment First Available: Friday, November 12, 2010 09:30 AM. But I am not able to schedule an appointment. All of the steps I performed on Yesterday. So I have waited for today for any changes and all remains the same.
Please help me.

Hi guys
I have a query; I had applied for H1 visa (2007 � 2008) from 2 places
One from my current working company and another from consultancy firm in US. I got through the lottery from both the places. I have done my stamping for the visa from consulting firm.
Now my question is will I be allowed to go for stamping again :rolleyes:. What are my options now if I want my visa stamped from my current working company :confused:.

hI ATTY I am working under an h1b visa right now as of 2011. But i had a previous petitioned by another employer way back 2006. There was an I-140 filed but it was denied and I never heard from my petitioner then. I do have the USCIS copy and case number. Can I look for another employer and atty that could reopen the case?? I am from India.I am on H4(dependent visa),with a stamped expiry date of May 7,2010 on my H4 visa and I-94.I got a J1 offer for further studies in USA.Till I get my required documents for J1 visa,I am guessing it will be beyond this date.My husband has already applied for his visa extension.
1.Now,if I plan to get stamping of J1 in Mexico after the H4 expiry date but with necessary receipts and documents (for H4 related),will I face any problems?
2.Do I need to go to India(my home country) for sure for stamping?
3.Is it better to have status change in USA itself(will delay start of the course)?

Hi All,
I am in EB3 with priority date of 2003 nov, I have a masters degree in US. Because of my negligence I applied in eb3. my i140 is cleared in eb3. waiting for priority date. Now I am planning to file eb2 perm and make us of the old priority date. Before joining for work I completed all the course work but didnt get the degree. I got the degree one year after I joined for work. My graduation date in the degree certificate is 5 months after my priority date. Will this raise red flags in the eb2 I-140 stage. Would it be safer for me to go for regular i-140 or premium processing. Any help or suggestion will be deeply appreciated.

I applied for my first EAD in May 2007 and had FP done in June 2007. I am now applying for my EAD renewal. Will there be another FP for the renewal?
This is really urgent as I am traveling to India in April for a month and I don't want to miss the FP appointment. Please let me know if you have info on this?

Yes, with out a backup up of big institutions(this case MIT) this dream or idea would have just lived like any wish or it would have taken 3 or 4 times longer.
