Hi,
My visa expires in May 2009. I applied for OPT and starting date will be from June 1st 2009. I want to go to India in the last quarter of 2009. How do I get a valid visa. Should I get a new F1 Visa? Please help me..

It shouldn't have any negative effect. It would be better to withdraw the application, rather than just abandon it.

Hello,
Please guide me in my situation.
I am on OPT right now which is valid thru May 2008. I have already applied for H1 through Company A in April this year. I got a job offer from Company B recently. I would like to join Company B and start working for it on my OPT. Company A failed to provide job for me so I wish to transfer my H1 (once after it is approved) to Company B. Now I have the following questions:
1. What happens to my OPT after I get approved for H1 through Company A?
2. Do I have to stop working for Company B as soon as I get my H1?
3. Can I transfer the H1 I get for Company A to Company B without any paystubs?
4. Can I refuse the H1 and continue to work for Company B on my OPT and then apply for fresh H1 in 2008?
5. Is there any possibility for Company A to cancel my status and make me go back to India?
Please help. I am totally lost and confused.....:confused:

Mine was filed in august 2007. It took 45 days for it to get audited and it has ever since been in process, that is close to 7 months after audit response.

Hi Guys,
I used to work for company �a� which was a part of the bigger company �A�. There was another company �b� which was a part of the bigger company �B�.
Now both companies A and B made a joint venture (JV) and made company �c� joining company �a� and �b�.
Company A has 25% stake and company B has 75% stake in JV(Company "c"). The new formed company "c" has �new name�, all employees filed �new employment applications� and have �offered a new employment� with the new company �c�
Now my question is as this company �c� is totally �new�, can I convert my EB3 case to EB2 and use company �a� experience and file for EB2 with company �c�

One of the comments on my post earlier today about the killed Border Patrol agent seemed pretty harsh - accusing most BP agents of being restrictionists with bad motives. I still think that's harsh and most Border Patrol agents are honestly out to do the necessary job of protecting our country's borders. I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.
Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?
Please advise.

Hey.
Im new to photography and am looking into photography for local music venues.
I have a D40 with its standard 18-55mm lens but I'm looking for a lens with a better aperture.
I am looking to get the Nikon 55mm f1.8 which is around �80.
As this is not an AF-S lens and can not focus automatically, will it sitll work with the D40 if I use manual focus?

You need to get a copy of 140, so you may have to tell your employer about your AC21 (actually no need if you have a copy of approved 140). Nothing to get scared of. But its good to leave in good terms.
Once you start using EAD your H1 will get cancelled anyway. So it wont make any difference if your old employer cancels it.

I tried checking my I-485 status over phone. I called after hours. So it went to the automated message. Thought just to listen what the message says. It was something interesting. Thought to share with you. Do any of you have the same or similar experience?
07/02/2007 - Application Receipt Date in I-485 notice.
09/04/2007 - Application Notice Date in I-485 receipt.
08/01/2007 - Application Receipt date according to the Phone Status(Automated).:confused:
09/01/2007 - Application Receipt date according to the uscis.com website Status check.:confused:
Just curious about these variations as none of these dates are matching.:confused:

Hi,
My I-140 was filed at VSC on 7/7/07. It was later transferred to TSC.
In this case, would I base my I-140 processing time on VSC which is stucked at 04/01/2006 or TSC which is at 08/15/2007?
I was hoping the later but I just called USCIS customer service and they said that A) it is based on WHERE YOU INITIALLY FILED and B) my application will eventually be sent back to VSC. I appreciate if someone can verify this. Thanks.

ICE has announced sentencing in two cases related to visa fraud. Houston immigration lawyer Kenneth Rothey has been sentenced to fourteen months in prison for money laundering and visa fraud. My application was filed in EB3 category and PD is current (has been since start of this year). I have an approved I-140 since Feb 07 and the I-485 was filed prior to the mess of 2007. I have taken 4 Infopass appointments trying to find out why is it taking this long to get "a decision". At this point, I don't care what the decision is, as long as there is one so that I can move on in my life. Called and spoke with the processing center that the case is outside their "normal processing time" only to hear, "We are processing". They won't tell me what is going on.
Wondering about my options here? Congressional inquiry? Writ of Mandamus? Anything? Anyone in the same position as me?
